This study is a historical research aiming to empirically explain the transition of legal position of schools for foreigners in Japan after the Second World War and considering the way Japanese education system including those schools exists. It has been long since several bodies such as the Committee on the Rights of the Child and the Committee on the Elimination of Racial Discrimination raised concerns over the problems in guaranteeing the system for foreign schools in Japan, but even today, when the society is calling for the multicultural symbiotic form, the government has failed to find the solutions so far. However, once there were public Korean schools run at the government expense, which we can rarely find in the world, and a bill about schools for foreigners aiming to secure its legal position by putting them within Japanese public education system between 1945 and 1960s. Although these systems and bills were abolished, and the legal position of the schools for foreigners ended up being positioned and unchanged as “miscellaneous school” to date, it is historically suggestive fact in the meaning that it could have set up an educational system open to foreigners. In this analysis, I will explore the logics and negotiations which have drawn boundaries having excluded schools for foreigners from public education system and how has it been unchanged, and by analysing this process, find a way to rebuild an education system which follows the time of globalization.
